Wherever used herein, the term “equipment” shall include any equipment rented from Goat Trails. Goat Trails, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall Goat Trails be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Goat Trails, or of any agent or supplier, or due to force majeure. Renters follow any suggested itinerary at their own risk and agree not to hold Goat Trails responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. Helmets are provided with no extra cost. The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. Individual bike specifications are subject to change based on availability of replacement components. Instruction in the use, assembly and maintenance of bicycles will not be provided and participants affirm that they are competent and familiar with the use of a multi-speed bicycle.
DELIVERY AND COLLECTION
Goat Trails offer delivery and collection service in a range of 5 km around the City of Chios or even at the accommodation places, located in Chios town, Karfas, Agia Ermioni, Megas Limionas. Up to four (4) bikes the service is free. For more than four (4) bikes the service is provided after personal contact for arrangement.
Renters are responsible for ensuring that management at their accommodation is agreeable to accepting bikes or bike delivery and providing safe storage for bikes. Renters staying in private residences or other locations from the above mentioned may collect bikes from City of Chios agreed by Goat Trails and return them to the same place as agreed.
MAINTENANCE, TUNING AND RESPONSIBILITY
Although all our bikes are professionally serviced before dispatch, bicycles may need tuning or maintenance during the course of the rental period; such maintenance will be carried out at the renter’s expense. Goat Trails will cover the cost of damages due to equipment failures beyond the renters control; i.e. damage occurred during transport or worn parts. Any deficiencies must be communicated to Goat Trails within 48 hours of receipt of the equipment. To be eligible for a refund on such parts and service, you must provide Goat Trails with a photo of the damaged or worn parts and an invoice for new parts or services. Goat Trails is responsible for structural deficiencies such as damaged frames, worn bottom brackets, suspension and wheel hubs. Goat Trails is not responsible for the following occurrences during bike rental: gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / damage beyond the control of Goat Trails and resultant of rider use or misuse.
If you are undertaking an unassisted bicycle tour, we strongly recommend that you have some basic bicycle maintenance knowledge. A list of the closest bike shops can be provided on request.
RESPONSIBILITY FOR DAMAGE OR LOSS
Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Goat Trails for said equipment. Therefore regardless of the party at fault, customer understands and agrees to be responsible for the theft or damage to said equipment.
Customer understands and agrees that any subleasing of rental equipment is prohibited and that any such sublease shall immediately cause termination and cancellation of this contract.
Customer shall assume liability for any and all damage or loss of and to personal/ property, accident / injury to other persons related to said rental equipment.
DESCRIPTION OF THE INSURED PERIL
The aforementioned cover is about the public liability of the insured towards third parties (including the participants) for accidents that may occur to them by wrongful acts or failure to act of the insured or people acting on behalf of the insured and are related to his professional activity, namely bicycle rent and touring management.
DEDUCTIBLE: 650 in every claim
It is attached herewith the special terms that cover the present insurance policy.
From the aforementioned insurance policy are excluded claims deriving from:
– Political acts, acts of terrorism, malicious acts
– Infection (gradual or not) – pollution of the environment.
– bodily injury caused by pathological causes or a predominant disease of bad health condition regardless of whether it was already known.
– Loss or theft of money, jewellery, electronic devices (mobile phones, laptops etc) and every personal item of the clients.
THEFT AND DAMAGE INSURANCE
You may pay an additional Theft & Damage insurance fee which in case of theft or damage to the bicycle will reduce payments by half those on our Price List. In case of theft a formal Police Report must be lodged and a copy must be forwarded to us in order to activate the insurance. In case of damage a photo must be provided to us.
Bike rental: Upon confirmation, a deposit of €50 per bike is requested to secure your reservation. This deposit is applied to your invoice and the remaining balance is payable up to 14 days before your due date or your reservation is subject to cancellation.
We may require a damage deposit of €100 per bike in the form of credit card charge or cash plus the driver’s license / photo ID of one member of the party. Any deposit given by the customer shall be applied to and guarantee the faithful performance of all the provisions of this agreement and all repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, customer agrees to pay all legal fees, court costs, or other expenses. The deposit returns to the renters as soon as the aforementioned equipment is given back and provided all the terms have been observed.
Tours & Experiences: Upon confirmation, a deposit of 30% of the cost is requested to secure your reservation. This deposit is applied to your invoice and the remaining balance is payable up to 30 days before your due date or your reservation is subject to cancellation.
CANCELLATIONS AND REFUNDS
Bike rentals: Cancellations received 30 days or more before your start date will receive a full refund of any monies paid to date. Cancellations received 14 to 29 days before your start date will be refunded any monies paid minus a cancellation fee of €50. Cancellations made 13 days or less before your start date are not eligible for refund.
Tours & Experiences: Cancellations received 30 days or more before your start date will receive a full refund of any monies paid to date. Cancellations received less than 30 days before your start date are not eligible for refund.
Rentals ending before the end date are not eligible for refund. All applicable refunds will be issued upon return of all rented equipment.
LATE RETURN FEE :
An additional day’s rental fee will be charged for each day customer keeps equipment after the return date specified on this contract. All equipment must be returned directly to Goat Trails or wherever agreed.
TERMINATION OF AGREEMENT:
Customer agrees that Goat Trails has the right to terminate this agreement at any time and retake possession of said equipment and for said purpose Goat Trails may enter upon the premises of the customer without becoming liable for trespass.
